What to do if denied disability benefits in South Carolina?

If your application for Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) benefits in South Carolina is denied, don’t be discouraged. Many valid claims are initially denied, but you have the right to appeal and take steps to improve your chances of approval.

Here’s what you should do if you receive a denial.

Find out if you qualify for SSDI benefits. Pre-qualify in 60 seconds for up to $4,018 per month and 12 months back pay.

Please answer a few questions to help us determine your eligibility.

1. Understand the Reason for Denial

The Social Security Administration (SSA) will send you a denial letter explaining why your claim was rejected. Common reasons include:

  • Insufficient medical evidence
  • Your condition isn’t considered severe enough
  • You can still perform other work
  • Errors or missing information on your application

Carefully review this letter to understand what you need to address in your appeal.

2. File a Request for Reconsideration

You have 60 days from the date of the denial letter to request a reconsideration. This is a complete review of your claim by someone who didn’t take part in the initial decision.

During reconsideration, you can submit new medical records or evidence that wasn’t included the first time. Be thorough and provide as much supporting documentation as possible.

3. Prepare for a Hearing

If reconsideration is denied, you can request a hearing before an Administrative Law Judge (ALJ). This is your opportunity to present your case in person, either in South Carolina or via video.

Hearings often result in many successful approvals, especially if you are well-prepared and have strong medical evidence.

4. Continue Appeals if Necessary

If the ALJ denies your claim, you may ask the Appeals Council to review your case. If still unsuccessful, federal court is the final step. These stages can take more time but may be necessary for complex cases.

5. Stay Organized and Meet Deadlines

Throughout the appeals process, keep copies of all correspondence, medical records, and documents. Respond promptly to SSA requests and meet all filing deadlines to avoid losing your appeal rights.
